The "New" New York State Code

The 2007 Residential code of NY (based on the 2003 I.C.C. Residential Code which is based on the 2002 NEC) is in effect 10/03/2007.   There is a 90 day grace period when you can use the 2007 or the 2003 RC (1999 NEC).   After 1/1/08 you can only use the 2007 RC for residential construction.  The applicable code is based on the date of permit issuance not on the inspection date.   The local Authority Having Jurisdiction [A.H.J.] will be responsible for determining  code applicability.  Text below from State web site.

Adoption of the 2007 Codes of New York State Update to the Uniform Fire Prevention and Building Code and State Energy Conservation Construction Code.

Transition period for Uniform Code is October 3, 2007 to December 31, 2007.
Uniform Code will become effective on January 1, 2008.
Energy Code has no transition period, effective January 1, 2008.

Requirements for the construction, alteration, movement, enlargement, replacement, repair, equipment, use and occupancy, location, removal and demolition of detached one and two-family dwellings, attached one-family dwellings (townhouses) not more than three stories in height with a separate means of egress, and their accessory structures are set forth in a publication entitled Residential Code of New York State.
